Pressure from airlines to keep schedule and minimize fuel expense in the form of performance review/rewards/bonuses. Strong captains can resists but the pressure is constant. Right now we dont know what happened but it will be months before anything comes out.
Also overall safety record of AF is now pathetic, blame it on weather or something else.

This question is not to undermine the effort, which was tremendous but just from a realistic point of view...
I'm just curious to know how long it will take (or rather how long we are prepared to wait) for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result ?
Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?
If the same question has been already raised, please ignore.

Change always takes time. Being in DC and visiting lawmakers was an incredible crash course for me in the practicalities of American politics. It was fascinating. I have to say it was one of the most satisfying things I've ever done in my life.

I probablly know the answer to my own question, but would like to know other opinions. My lawyere tells me this. Since the dates were current when I filed for my I485 in July, the application will be processed regardless of what the dates are right now. Another words, he thinks that even though the dates are showing as 2002, my application will be processed since when we filed, they were current.
is this true. If so, then provided I pass background check in time, i should expect my GC in a year or so. but if I have to wait until 2002 Row becomes current, in my case 2005.. then I am majorlly scrwed...

Your application will be processed until the stage where a visa number is needed to adjudicate your case. Since EB3 (am assuming here) ROW is not current. Your app will wait until visa numbers for your category becomes current. In other words, your last sentence may be true. But not if you become vocal about your plight and fight for it through activism (i.e by supporting Immigration Voice).

i had sent an email to CISOmbudsman.. requesting allowing to file for AOS..as a mode of temporary relief...they replied..saying thanks for the input...
I think we must pursue this for now... since any meaning reforms are atleast couples of months away.. this relief can save lots of EB ppl during uncertain times.

This is a great finding I've read that page, but never noticed the Secretary of DHS specifically mentioned Pre-Application of AOS. Now that they do have this in their mind, can we start working on that? I'd love to share a few thoughts I have on it:
From the lessons we learnt from the past, the most important thing for this admin fix to fly is compromise: there must be kind of restriction for the pre-application AOS. A few examples I could think of are:
- The person has been in the country LEGALLY for more than a number of years, OR
- The PD are more than a certain number years old, OR
- I-140 has been approved, OR
- Must have MS or higher for a US college (just for argument's sake, please don't flame me).
The key is to not allow everyone to file pre-application or it'll be drown in a media storm and draw backfires. Yet it gives you a certain promise that you'll be able to file pre-application once you are here for a certain period of time, so everyone has hope and those who has suffered more would have an almost certain chance to do so.
IV core, should we work on this? This is the first time we see pre-application of AOS appears in official file and I believe it's a great opportunity.

This time mostly bill will be passed in the senate. But no one knows how house will handle. If house also passes some form of CIR then Conference commitee will have power for synchronisation of house and Senate. That time some important provisions could be thrown out. Who will be in conference comittee?
as far as i know Reid is smart about this thats why hes using the "clay pigeon" manuevre where all the 24 amendments would be tied as one amendment and then voted to pass on, once its passed then the cloture vote will come in (without the individual amdts yet voted on) once the cloture vote is secured then they will have 30 hours to vote all the individual 24 amdts after whc a simple majority vote ( min 51 votes) wud be needed to clear the bill...real smart

Now it's clear. You don't want people to drag you down, even when they have had gone through everything, Labor, I-140, been in the country for 10 years, etc. -- I thought you had a noble cause from the older posts, but apparently I was wrong.
This also started getting ridiculous. In my own post, and agreed by almost everyone else, I specially said to put on restrictions to those who can file AOS, e.g. with I-1140 approved, or with a PD older than a certain number of years. Where did you get the impression that every H1 can arrive this country and be on EAD in six months? Why did I found that the extreme generalization and scare tactic employed by you has an alarming resemblance to those from Lou Dobbs and Grassley?
And to answer your last question, even with a PD of 2007, I've been in the US for ten years, but could not file green card due to company bankruptcy, layoff, etc. and I am 90% certain you've been here shorter than I am. Then should give up your EAD till everyone who stays here longer than you does?

I am with you on the ludacris comparison brought by hydboy77. He keeps calling the EB3-EB2 porting line cutters as if these guys were paying 10,000 USD to buy substitute labors. Those Eb-3 folks have stood in line just like him, you and me and have an employer who values their contributions and has a position that has EB-2 requirements he can hire this EB-3 guy. Rather than thinking about the problem at its root, he keeps attacking people who port their PD and calls them line cutters. Bottome line: He has EB2 PD and worries that he will be screwed worse. While it is good to worry about the problem, it worries me when that worry comes at the expens of other's good. Jeez! we dont need anti's. We get dragged down by your own. Probably he does not know what USC code 1571 section 8 says even before AC21 came into picture. Congressional intent was to get a GC for every one with in 6 months. Infact he does not want every one to get EAD because he is scared. Doesn't a legislation that takes out the similar/same after 6 months and gets every one on to EAD is the best one as people will be able to demand what ever they want and put the kabosh on Grassley who keeps bitching that H1B's are paid peanuts?

His whole argument about the 06 guys getting GC ahead of 03/04 guys is entirely different. DOS had no other way to handle the inefficient USCIS other than forwarding dates ahead. I dont know whether he would have been happy, if DOS did not move dates and neither 04 guys and 06 guys got their GC, 20,000 visa numbers were wasted. I for one have a 02 PD and am happy for those who got out of the hell hole, regardless of their PD and at the same time I will keep pushing for USCIS to get better. I am actually seeing this effect in DOS VB this year. DOS is getting better at the game and moving the dates slowly and this summer EB-2 I/C will not go beyond Jun/Jul 05.

The bill brings in 200,000 guest-workers each year (it was 400,000 before Bingaman amendment). However, according to him, that is just fine. When guest-workers come to US in numbers like 200,000 then they dont depress wages of the lowest income group in America. However, when hi-tech workers come here they depress wages.

There are some significant flaws in your analysis. If you correct them, the number comes to around 25K.
First. The family spill over has to be applied to all categories. So the total number is 140,000 + 19,000.
Second. You calculated EB1/2/3 gets 1/3 which is not correct. They use only 28.6% not 33.3% This makes difference.
Third. The EB1+EB2 combined 70K already counted 9,800 visas for India. We should not add them again.
According to USCIS/DOS testimonies they will usually end up using only 95% of total quota. They go conservatively because they must ensure that they won't use up even a single visa more than what law allows.So total available is approximately 159000*.95 = 151050
Third. EB1, EB2, EB3 each will get 28.6%. Not one third (33.3%). That makes lot of difference. So each category will get around 43,200.
EB4 and EB5 combined will get around 21,449
Now again, going by statistics and your assumptions that EB1 and EB2 takes up 70K and EB4, EB5 takes up around 10K. The unused visas are
((43,200*2)+21,449) - (70,000+10000) = 27849.
So the total EB2 visa usage will be around 70K + 25K =95K.
Based on your calculation its 27849 additional visas + 1/3 of 9,800 (=3,266) = 31115 for EB2 India for 2008 fiscal year and the coming years ahead.
So this is almost 10 times more visas for EB2 India. So EB2 is going to be fixed for the time being.

Anything asking exemption from cap means asking unlimited numbers that should have real luck to pass in the Senate. If lobbying persons come with reasonable numbers then that should have some chance to pass. But it needs to be seen for the reaction of house.

I applied for my AP renewal on June 2nd by mail and the same got delivered on June 8th but no reply as of now. I sent me personal check for 305 USD. Please advice.

Which center did you apply for.
In my case, I filed through an attorney with TSC. My papers were Fedexed to reach on 6/2 and my attorney sent me scanned copy of receipt notice on 6/8, not sure when he received the RN's but the Receipt Date / Notice Date in the Recipet Notice is 6/2, If your documents reached on 6/8 which is a Monday, leave it a couple days and followup. You have to leave some time for the actual RN to reach you via USPS as well. The payment was made for my case to the Attorney and they cut a check for USCIS. So I do not know how soon the checks will be encashed. Good luck with your renewal process.
