Congrats: I feel better after seeing your posting. Mine too was received by R William at 7.55 on 7/2. May be it is on way too

Thanks. It appears they are working their way through the July 2nd filers. I was getting quite nervous as my current visa expires this year and is non-renewable. If the checks had not been cashed last week, I probably would have re-filed the paperwork this week. (If my attorney thought that would be in my best interest.)

Best of luck to you and all other's that are still losing sleep over this. ;)

I watched the video and One of the things I noticed was the difficulty the State dept is facing to keep the numbers within limitation so they tend to achieve 90%-95% because the legislative limitation doesn't allow them to go beyond even by few numbers

When i compare the same situation with that of an IPO of a company. Typically a company coming out with an IPO will have certain number of shares authorized to sell, In addition to that they also reserve certain small number in addition to these to accommodate any excess shares issued by the underwriters.

Why don't we have some numbers similar to that. This would make the life of the State dept much easier.

    Any thoughts

    What does this statement mean?

    http://www.uscis.gov/files/pressrelease/ReceiptingTimes06Jul07.pdf

per existing policies and procedures, requests for Premium Processing Service will continue to be processed within 15 days. USCIS wishes to assure all customers that the original received date (the date which the document is date stamped) will be honored and recorded on the receipt notice. This date will appear in the "Received Date" box on Form I-797, Notice of Action. The received date is different from the "Notice Date", which also appears on Form I-797. The Notice Date is the date the receipt notice was actually generated.

Why USCIS suddenly did this press release? Something fishy?

Wow, so you're telling me be happy as somebody else is in pain now ???
Their problems doesn't make me smile here. I want solutions to my problems.

If you need solutions to your problems, you need to act professionallly as all other IV members do. Please stop throwing tantrums and also mind your P's and Q's when you utter expletives against USCIS. Will you be brave enough (if not foolhardy enough) to reproduce whatever you said here in a letter and send it out to the USCIS? Trust me, you'll not since you'd act politely and professionally to make out your case. We expect you to act with decorum when you discuss pertinent issues in IV forum.

Does any one know about any fee increase for H1B(Extn) premium processing because of border security bill? I have seen the below in immigration-law site.
    ------------------
The new filing fees will be a huge amount, especially when they decide to file a premium processing request.

He is absolutely correct. 485 Processing would start depending on RD (Receipt Date). But at the time of approval PD should be current and if it is current then the applicant whose RD (Receipt Date) is oldest would get the approval first.

receipt date if your PD is current.

EAD is not a visa status. It is an employment authorization document. Of course they will not accept it in lieu of H-1B.

What you need to do is show them the receipt of your I-485 application with the A#.

In my case too he asked me if I was on EAD and I said yes. He said that I should then give him a copy of I-485 receipt. However, since I also maintain H-1B visa, I just gave him that.

HSBC denied my refinance application because of EAD status. They said EAD is not one of the statuses they accept. They needed either H1B or GC status. I lost my $325 rate locking fee, not sure what else my real estate attorney is going to charge me because of this denial. I am in the process of talking to other banks.

Hope this helps someone not to loose money.

Under the authority of the Homeland Security Act of 2002, the CIS Ombudsman assists individuals and employers who experience specific problems during the USCIS benefits seeking process, largely to identify problems and to formulate recommendations to improve the USCIS service. Please see our website for more information about the CIS Ombudsman (www.dhs.gov/cisombudsman/).

Our office believes that first hand information from individuals like you is the best source for identifying systemic problems in the immigration benefits process. Accordingly, our office will consider the information you provided regarding AC21 as we develop recommendations to improve USCIS practices and procedures.

Thank you for taking the time to contact our office, and for giving us the opportunity to serve you.

    Sincerely,

    CIS Ombudsman

    Thanks for the update.

Its positive and a direct answer to try improving USCIS practises regarding AC21. Hope more people will get inspired with this and send letters.

Note: from the earlier experiences it was pointed out that we need to send letters in thousands to get immediate attention. please keep sending.

Receipt date is not the date when the application reaches the service center. It is infact the date when your application is entered into their internal system which could be several days after the application has reached the service center.

And all application they enter into the system.. then give us a Receipt Date Right ... from that time we can apply for EAD / AP (will take time again)

A cut-off date avoids submission of AOS applications with PD after cut-off date. In my opinion, this was the only reason to retrogress on July 2: avoid AOS submission whose PDs became current in July.

Now nearly all AOS applications have been submitted. Hence, setting cut-off dates conservatively is not that motivating.

Cut-off days not only determine number of applications that can be received at their end, but also the make eligible applications approvable. I think at times when the cut-off date resulted in more approvable cases than USCIS can handle, then they move it back as well.

May be they should have two cut-off days instead of one like this:
    1. One for receiving applications beyond that date.
    2. Another for approval.
This may help them to pick necessary applications needed from this pool and approve them without losing the allocated visas.

I think change has to come from the legislation wing to amend the procedure in USCIS.

    Thanks

You morons, You have spent so much time in useless discussions and anti-immigrants are laughing at your foolishness. Its high time your greencards applications get a denial or RFE. You will come crying to IV to save your status. Or else you will be deported. That is all you can do. You guys have got sub labor or faked your resumes and now you want someone to be accountable to you. First learn to be accountable to yourself and your values.
Here is what antis are telling you aholes:
As for you fuckers over at Immigration Voice that caused this temporary outage, keep it up. The more time you waste harassing me, the less time you have to send flowers to politicians, begging for your green cards.

Give it up, slumdogs. The whole H-1B thing was like a little tryout to see if you scumbags could fit into American society. Since it is clear that the bigoted, misogynistic caste mentality is ingrained in your DNA, we have to send you home. Maybe we will make you wither in limbo for 10-20 years, dangling a green card in front of your eyes, but the end result will be the same. You will have to leave.

Unfortunately some of you may not live long enough to see that open sewer of a sub-continent again. You may die here in America, in an accident, or by natural causes, or commit suicide like all the techies in India are doing.

Either way, by death or deportation, you will be gone.

And Americans can go back into I.T. once again and reclaim the industry that we created.

    STFU you freeloaders
