so far, Senate Majority Harry Reid alsked the republicans to "stop" these things.. but we know they managed last year - so, if we don't do something, we may end up not receiving rebates this year also.. especially given the fact that Obama is trying to get support for this to pass in senate and not one republican voted for it in house...

Does anybody know how long an H1B visa can remain valid (including grace period) after a layoff ? What I know, is an H1B technically becomes invalid the day you stop rendering your services to your employer. The firm's lawyer suggested me to file for B1/B2 visitors visa to avoid going out-of-status.
If I do that, can I transfer my H1B visa (from B1B2) once I get a job? Or will I have to struggle against some quota?
Can anybody suggest a good lawyer in New York City or near Hoboken, NJ who can help we with all this? I tried contacting Cyrus Mehta, but he seems to be booked for another week.
Btw, thanks for the overwhelming response to my request for resources to find a job. While I am evaluating my options, please keep me in consideration for any openings that you see.

Uscis will invent thousand things to issue rfe, ead should be in a different league to h1 and it should not turn into another h1 where you are slapped with rfe left right and center. Example pay stub rfe, ability to pay RFE, customer purchase order RFE etc etc etc, green card holders don’t have any problem working in these same jobs so why should ead people face this nonsense (otherwise it is just like h1).

Hi,
I am from Jordan and I attended the rally. 4 of my friends "who are Jordanian and have their citizenships already" drove from Chicago to attend the rally, but they got lost in Baltimore. They wish all of us all the luck and they support all of us 100%:)
That have been said and as I mentioned on another threat, I know 10 people from India who work with me and promised to meet me there, but no one of them attended, and I called them before the rally at their offices and all of them were there. I am very disappointed of them.:mad:

I agree 100% with you. If you do not get your GC approved before those 25+ million people get in the line ahead of you. Remember they will have to send those 25 million names for namecheck and the government will do theirs before everybody else's.

EB3 porting is a loophole like labor substitution.
when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.
Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.
How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

Hi Everyone,
After checking in google, I found this information and felt very happy about it.
Until yesterday I was not aware of this condition and expecting the benefit from IRS. After checking the IRS schedule and validating the benefit, I was shocked when it said not eligible because of ITIN reasons. Initially I thought it was a mistake by IRS and called them up but there was no answer.
Now, I have little hope that they'll classify people who filed H1+H4 jointly should atleast consider for $600 benefit. I'm with two children and had initially high hope and a long list for spending the amount. But now that is all past....
I would like to thank you everyone for taking this step of passing on the information and following up with legal, SSA & IRS authorities. Please do let everyone in the list know if as a group anything can be done. I would also like to share towards it. I live Redmond, WA.
This is not right when other people who filed singly received the money not we. We're treated as illegal and I believe this is a discrimination for this group of people.

I have travelled AI around 6-7 times with no issues at all. On the other hand I have horrible experience with Continental and Air France.
As for your experience in Frankfurt (gift purchased in Duty Free in NY not allowed), this has nothing to do with AI. It is Security staff in Frankfurt. I suspect the gift included something liquid (alcohol or perfume etc) which are NOT allowed at security point.
That is why it is advised either to carry these stuff in your registered bag OR purchase it from a duty free at the last point where you board a flight.

I dealt with Fragomen for last 7 years. I can say following about my experience �
I work for fortune 500 company and Fragomen was the law firm my company used until early 2007.
1> The emails, voice mails I sent to them used to disappear in a �black hole�. I had to wonder whether and when any response will come to an urgent, time sensitive question.
2> Many times after waiting a week or so for response I had to escalate the matter to my company�s legal department to talk to Fragomen. This used to work like charm, I used to get answers within hours.
3> I had to keep them reminding them about next step to take, as delay from their part had cost me years in the processing.
4> I think many of my co workers had similar experience and that is why my company finally switched to different law firm in Jan 07.
5> I hoped to never to deal with them again but �last week I got invoice from Fragomen for something the did for my case in Jan 2006! I don�t know why they sent it so late and why directly to me instead of my company. Well, this time I am going to wait until they call me to take any action on that invoice.

I wouldn't make that decision until Oct of 2008.
My personal opinion and analysis tell me that EB2 will soon get retrogressed from what it is today and the picture will not be that rosy in a couple of months.
I would wait until Oct 2008 and see what kind of visa numbers are available at that time for EB2 and EB3 and them make any decision on switching.
Again..just my opinion.
