Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.

The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.

DO anyone has info on this

When I joined my employer, I had MS+2 years of experience, but my lawyer applied to me under the EB3 category which had MS+2 as an alternate qualification. I submitted the experience letters from my previous employers.

Now, my company is willing to upgrade from EB3 to EB2 and have a position that requires MS+2, but the job responsibilities is a little different from the EB3 job.

If I apply for this position, will the USCIS accept the experience letters submitted earlier?

I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.

Does she need any visa interview after filing the transferring f1 to H4?

Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).

PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.

In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

Only when I click the link, the page should load, but the page like auto runs without even displaying the main window. The main Window disappears in a flash and the Page.xaml appears. Hi,

I have been on H1 for the last 8 years. My most recent H1B was expiring in July 09 and my company had filed for an extension in June. Unfortunately, there was an RFE. When going through the RFE response, our attorney identified another mistake in the petition and believed the best action was to withdraw it and file a new H1 extension petition. The RFE 'respond by' date has also passed now. Since my previous H1 has expired, would this new H1 Extension petition be considered a valid one? I have my EAD and can continue to work on that till this H1 is approved. Please offer any suggestions you may have and let me know if there is anything else I can do.

My grand father and grand mother are trying to apply for visitor visa.. my grand father is a retired govt employee and grand mom is home maker.. my grandfather is coming on their own and we are not sponsoring them..he will be able to submit tax returns as he runs small business and owns 1 apartment and few lands my questions are:

1.what are the documents should he take for visa ?

2.how much of bank balance? (they say 6 months of bank statements is necessary)

3.cant he just say he's retired and take the asset evaluation and bank statements alone?

News letter to members is a good first step...I would suggest a news letter every week with just fund rising and also increasing memebership in mind .The wording should be tuned towards rising $$.You can put on big bold wordings at the top % met versus our target..

Keep rowing guys we are almost there!!


Also..somebody with good writing skills write 1/2 page letter..about 8 different formats and wordings...so we can print them out and gives us a list of senators address...each member can spend 37 cents...even better fedex these to senators asking for support on the Skil Bill...

Those who were able to upgrade to premium processing before Jul 2, did you get a new receipt number for the upgrade? Or was the old receipt number valid?

old one remains valid. Your status on that will indicate that the application has been upgraded to PP, and then the same reciept number will tell you about the decision

yes. Select it, then check out the left hand panel. I believe that "layout" will have a check box which says, "show object" or something similar. This is what you use to make an object transparent.

This will only work on peices of a grouped object... not the whole group.. keep this in mind.

I have applied for my PERM Labor Certification on Aug, 6th'07. My status online shows "IN PROCESS". DOL called my employer's contact to verify submission on Aug, 15th'07.
My Lawyer states that rather than preparing for I-140 / I-485. I would be best served in working on preparing a response to the audit that will be coming, because of the Spanish language requirement.
Is he just getting ready for a "just-in-case" audit...? Should I prepare the I-140 and deal with the audit on the 30-days if DOL sends the Audit letter? How long would it take to receive this letter?

I know this may be a little of topic but just bear with me. I am simply looking at alternatives in case the GC does not pull through. Does any one over here have any experiences living and working in the Middle east ? I just read an article about Saudi Arabia's economy dealing with record unemployment. They are in the process of taking jobs away from foreigners and giving it to the locals.

Well seems like today both sides are going to blame each other for not having a bill today. Big question is - does discussions/negotiations re-start after the recess or is this issue pretty much dead. Most probably they will announce that they will re-start the discussion after vacation and provide the "most important legislation"...blabla... I have an approved I797 from last year qouta. I got a 221g when I went to stamping for my H1 visa. The 221g was regarding some documents which the employer had to provide. Subsequently I obtained a L2 visa and I am now in the US. I would now like to apply for a change of status to H1.In this regard I had the following question:

On my L2 I have applied for a EAD about 3 weeks ago. USCIS says that it could take upto 90 days to approve the same.During this time if I apply for a COS to H1, would it influence the decision making on the L2-EAD approval or they are completely separate processes?

Now, we are planning to travel to India. She has her old as well as new passport .. and the F1 visa and I-94 is still at the old passport.

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.

I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

My AP got approved with incorrect A#.

Where as receipt notice has correct A#.

Please let me know, what I need to do to get correct A# on my AP?

Hello All,

I recently filed a labor and got A# and would like to know the options to check the status.

My employer is not willing to give the user id and password of the secured sire through which they filed the labor.

I would greatly appreciate your input.

Status of PERM can only be checked by your employer (with their user id and password of the secured site). Unfortunately there is no other way to check the status.
