We are applying for my husband's H4 extension now. ( My new H1b extension was approved only till Sept 25, 2009 based on the SOW( client contract) rather than 3 years)So he would be able to get his extention same as me Sept 25, 2009.
We have also applied for my husband's H1b this year. Hopefully, if his H1b is approved
1. Does he has to go outside US to get his visa stamped to start working from Oct 1, as there is no status for him from Sept 26 through Sept 30 ( 5 days)
2. If we apply for his H4 extension along with my H1b extension during early Sept and he will remain in status as the Case will be pending, Does it allow him to start working on H1b without needing to stamp?

Hi,
I am a doctoral student in clinical psychology, graduating next year in May or October. I am currently on an F-1 student visa and have heard ominous things about getting an H1-b and GC in my field.
I know I have time and things can change, but it seems like they are becoming more difficult. Hence if there are people out there who have ideas, experiences and information to share about what the process is like for potential psychologists to get sponsored, I would greatly appreciate your reply.

With all the uncertainity about dates moving backwards (unpredictable) is it better to go for AOS.
Is it true if you go for CP and dates move back..then your application is not approved untill dates become current?

My company is processing my Green card and recently applied my I-140. My wife is applying for residency this year. Most of hospitals are saying that they can sponsor only a J-1 visa. Can you please suggest if this would be a problem for my Green Card processing and/or her visa stamping (Since applying for G.C means that we wants to stay and J-1 means the other way round)?

I have B1 visa and and right now I am in US on client support.
I want to get into a College for further studies for which I am unaware of the legal formalities to be completed.
I already have a letter of internship with a US company and the college is giving me a letter for change of status i-20.
As far as the immigration goes for change of status of visa, it says that I need to go out of the country and then come back, with stamped as 'intent to study'. So is it really required?
However still it is confusing for me as to what other formalities are to be completed regarding the same.

Hi, we gat our GCs in aug 2008. My husband works for a Swiss bank in US. They are offering a promotion and move to Europe. If he accepts how will it affect our GC and eligibility for Citizenship in the future.

Hi,
I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?
This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

I am curently on h1b visa on 7th year.My i-140 got approved 3years back and filed i-485 in 2007 and waiting for gc.Now if i switch my job to different employer using my EAD,Can my previous employer revoke my i-140 affecting my gc processing.Does he still have control to withdraw.Can you please help on this.Thanks.
Employer can withdraw anytime. But you should be OK with AC21 provisions.

Will it be ok to change employers multiple times on EAD with in shrt span of time difference?
yes, after being a 'chicken' for so long, I changed job on AC21 six months back. And since then changed twice after that. (once forced due to economy, second time moved to a better position) in fact now I am loving the freedom that comes with EAD. Only make sure you stick to same profession (programming) other things like salary or job title etc doesn't matter. Good Luck!

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? I recommend visiting USCIS page at USCIS - FORMS (http://www.uscis.gov/forms) and doing it yourself as it is the best way to master this.
It is a simple form except that you have to patiently go through the instructions.
As for identification document, if you are applying for an extension of EAD, copy of front and back of previous EAD is enough. You don't need to provide a drivers license copy or any other form of identification.
