My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!
I am so frustrated that I feel like going back to home country now.

Hi Friends,
I have been cheated by a desi consulting company e-Data experts located in Harrisburg, PA. They applied for my labor in December of 2007 and it was audited and finally I was told in June 2010 that it was denied. Actually it was denied in January 2010 but they did not reveal this information intentionally. Now I am in my 6th year of my H1b which expires in March 2011. Can someone help me out how to sue the company for not revealing the information and firstly how can I stay in the country. BTW I have done Masters here and I am with another company now. Appreciate all your suggestions.

Hi,
I have I-140 approved(ABC company) and have 5 months left in my first 6 year cycle. I was laid off from the job. A New employer XYZ applied for my H1B extension based on I-140 approval and got approved for 3 years.But I was unable to join
XYZ due to family situation and moved back to India.
Questions:
1. Can a new employer apply for H1B extension based on my I-140 approval even though I am not in USA.? My I-140 has not been revoked or cancelled.
or
2.Can I claim the remaining time on my H1B approval(based on I-140) with company XYZ ?I have copy of the H1B approval but not sure if it has been revoked.
Please advice.

My wife is going for h1b stamping in Chennai on Jan 17th. She converted from H4 to H1 and and is doing her first year residency in a community hospital in New York. We have all required documentation. Letter from Hosp, 797, 129, LCA, offer letter, ECFMG certification, USMLE transcripts, degree, school transcripts.
In addition, I am asking her to take utility bills and bank certificates and paystubs.
As she was in h4 for 2 years, would the VO be asking her for my stuff like, my w2s, my paystubs etc????
Has anyone gone through this? Any specific questions related to residency? Does she need to take information about the hospital like brochures, etc.... does a visa interview for a Physician focus on the hospital and its operations????

On March 17, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Eventhough I did not get notice yet by mail I am little confused and concerended with their message, I have couple of questions
1) Does this really means my AOS application is approved? Is there anything else I should do?
2) what is ADIT processing that they are referening to?
Any thoughts or experiences from the gurus here is really appreciated.

You are already counted in the quota. So it is just transfer. But for transfer need recent paystubs. Consult a lawyer how to handle this. Definitly you no need to wait for April 1 st quota for new H1B.

I am on 6th year of H1B. My visa expires in Sep 2009. My mom is likely to appear for B1 by Oct 2009. My 7th H1B extension has been approved, but I have not stamped the visa

Thanks for looking at my questions. I have an approved eb2 case with priority date 11/2007. I am waiting for eb2 India to become current for applying for EAD for my wife. She applied for medical residency and the programs she got calls for are sponsoring J1 visas only. I have a phd from US university and applying for EB1 OR through a semi conductor company anyway.
I am in dilemma whether to apply for EAD for my wife or let her go on J1. J1 has implications later for medicine students but given the randomness of USCIS, I am never sure when eb2 date would be 11/2007 for eb2 485 or denial of eb1 or application.
Please advise me over this dilemma.

Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer.
