No. You must already have 485 pending, or you should be applying 765 along with your 485 concurrently. However to apply for 485, your PD must be current.
I got my labor and 140 cleared few months back under EB3, Can I apply for 765 to get my EAD ?
I have not applied for 485.
Please let me know.

Thanks for maintaining excellent site and answering all sorts of different complex questions.
Now my story.
I am going to apply in next H1B quota and was having below queries:
1. I am confuse about what kind of h1b interview questions will be ask by consulate officer
2. Will they ask my previous work experience letter.. because currently I am in Australia and my work experience was in India and there's no way I can have letter now.
3. How's the job market for Enterprise Oracle DBA
4. And Do I need to keep any extra precautions from start in order to be safe from all future legal problems being a consultant.

> Traveling to US on June-15, 2011
> Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011
1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?
Appreciate any inputs on this.

prevailing wage calculations for EB-2 applications to be filed for Sr. Systems Analyst and Sr. Software Engineer. As of January 1, 2010, these wage requests have to be filed using US DOL�s electronic iCert system. For the past couple of years, the NJ DOL had given us LEVEL II wages for these positions. Now, US DOL is giving us LEVEL III wages for these positions which is at $102,274
EB-2 Software Engineer/Systems Analyst LEVEL III at $102,274 , or file under EB-2 ITPM LEVEL II at $116,501
I wanted to confirm whether these wage Calculations Declared by DOL are correct to file for EB2 category and do we need to quote such high salary ranges.I have master's degree plus 5+years of Experience in IT field.So, i will qualify for EB2 category but only wanted to confirm whether the wages declared by DOL were correct in respect to Jan 2010

Pelosi noted at a January news conference that so many Republicans voted for the Democratic proposals that one of her colleagues joked: "Maybe you made these bills too easy."
The Senate Democrats quickly pushed through a different version of the minimum-wage increase, and the party's leading foreign policy voices framed a critique of President Bush's Iraq policy that squared with the public's increasingly skeptical view of the war.
But recent weeks have held nothing but trouble for Democrats -- and it is odd, as one Democrat noted, that they should be on the defensive when the scandal over the treatment of wounded veterans at Walter Reed Army Medical Center has focused attention on yet another failed aspect of the administration's execution of the war and its aftermath.
Instead, one news story after another has highlighted differences among congressional Democrats over how to end the war. There is also the divide between the Washington party and activists at the grass roots and in the blogosphere. All of these problems are rooted in two unalterable facts: Democrats, on the basis of their thin majorities in Congress, lack the numbers to force an unwilling president to alter his course. And they are short of votes to cut off funds for the war altogether.

Dems are not united on most issues.
Although this article is on Iraq, a similar situation will occur on Immigration. The big difference is that Dems are very interested in Iraq (they won elections on Iraq) whereas I haven't seen much much Democratic interest on Immigration.

Depends on what is written in your LC job requirements. If it is either Masters or BS + 5 yrs of experience, then - yes, you can file I140 in EB2.

Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?

Could someone tell me please.....I'm filling the application for advance parole the first time......what should I write where it is written: " Date of intended departure"...if I dont know exactly when I'm leaving....should I write a date or should I write " I dont know yet?"
And also I read that the documents required are 2 photos, I-485 receipt notice, I-140 approval notice.....is that right? or what other documents do I need?

I assume that your girlfriend is a US citizen. See here for the permanent residence (PR) procedure: Family-based Marriage Immigration categories - Elaine Martin Attorney (http://martinvisalaw.com/family_lpr.html). Getting married or starting the PR process should not affect your company's L-1 extension petition.

I wonder if they are approving I-140s for people whose priority dates are current to expedite their GC approval. Have you already done your finger printing?
