USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.
Hence, it again is necessary to have an Approved LCA in place for the proper location at the time of the H-1B filing. The reason the exception was not extended is that the DOL assured USCIS that LCAs are being processed within the required seven-day processing time. The DOL, in fact, stated that LCAs are being processed within four to five days which is in fact true as well. It is our suggestion to plan accordingly.

Hi,
I have my L1 Visa from X Company and I traveled to US for 2 months.
I also have my H1B Visa from Y Company stamped in my passport.
I am planning to enter US with my L1 Visa and then change my status to H1B after a month.
1) If I get a job, can I change my status from L1 to H1 within a month? Is there any minimum period to work on L1 for change of status?
2) Do I need the consent of my X Company for having the change of status to H1B done?
3) What documents are required for the change of status? I will not have my pay stubs during my stay on L1 status, as I will be paid just the per diam.
4) If I enter US with my H1B Visa and if I am deported to my Home country (because I just have 7 months) validity of my H1B (or) due to employer-employee relationship issue), can I still use my L1 Visa of my X Company to revisit US?
Please advise.

Option1 -
Get enrolled in some university and get F1. Full time classes can give you 2-3 years of stay.
Option2-
Covert status to B1/B2. That would just buy you 6 months at the max.
Option3-
Pack up and go back to home country. Live a free life.

You can file I-485 only when your PD is current. There is no connection between filing for I-485 and I-140 approval.

Just want to know my options here and here is my scenario:
I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I don't have the copy of my I-140 but I think I can get it.

Hi,
I have a question regarding the I765 form. In the I 765 form it says Have you ever before applied for EAD to USCIS. I did my MS from US University and got OPT also known as EAD and worked on it for an year. Now my question is do i check yes or no? Do i consider that as EAD or just OPT.

Hello All,
My I-140 was approved on 10/08/2008. But I am not sure if it is EB2 or EB3.
My labor was filed with MS + 2years but My I-140 Notice Type says:
Skilled Worker or Professinal, Sec 203(b) (3) (A) (i) or (ii).
I will appreciate any feedback.

Hi,
I got my EAD recenltly and my I140 approved long time back but my employer is keeping my I140 receipt number as a secret (both HR and attorney). Is there any way i can get I140 receipt number? do i need this if i want to use AC21 before or after 180 days ?

My wife is MS Graduate with degree in Electrical Engg - wireless specialization.
She switched from F1 to H4 as she couldnot find a job.
Now that she can work from Oct, she is seeking suitable job.
If any of you folks know any consulting/full-time employer seeking candidates, please PM me.
I would greatly appreciate any help that I can get in this regard.

Would like to know if anyone has any H1B extensions approved/RFE's/denied (whether regular or premium processing) after the January 8 USCIS memo. Please indicate whether full-time or consultant.
I applied for H1B extension - receipt date December 23rd, 2009. Upgraded to premium on January 21, 2010 (Jan 21 date updated in case status on USCIS website). Working as full-time - (empoloyer is not into consulting), Extension is for 3 years beyond 6 years, I-140 approved.
Also, anyone know how long does it take these days for extensions under Premium processing to be approved.

Yes, as long as you have valid AP, you can re-enter and resume working on a valid EAD.
