Hi all,
I am on h1b right now but had applied only for AP since i do not have valid stamping on my passport but have an approved renewed h1b extension valid till 2012.
My AP will be expiring coming nov 2009 and have the following questions,
1) How many days before expiry can i apply for the AP renewal. If i apply now the texas processing times for AP is around Apr 1 2009, does it mean the new AP they will provide from Aug 2009 to Aug 2010 or from my AP expiry date which is nov 2009 to nov 2010?
2) I am also thinking of applying for EAD to keep as a backup (just in case).
Can i apply EAD alone now and wait for nov to apply for AP (or should i apply both together) ?
3) If i do a paper based filing does it mean there will be no request for finger printing?

If you can wait for AP to get approved that would be a better choice. When did you applied for AP? I know couple of my friends whose AP got approved with in a month. It all depends on case to case. Don't take it granted as 2-3 month.

Are you legally in US i.e. can you travel in and out of US?
If not, then this forum may not be of use to you as the forum exlcusively addresses the issues surrounding legal immigration
Are you authorized to work in US i.e. do you have a social security number that is valid for employment
If yes, then you should report the abusing woman to police. If not, then you maybe in viloation of US employment and immigration laws

hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Please help me. Thanks

I have a work related travel (2 days max) coming up in January. Do I need a canadian visa. I am on AP and my US visa on my passport has expired. My H1 is valid till 2009 (not stamped on the passport).
My question is Do I need a canadian visa? Let me know if anyone had a similar experience.

If you are from a country who is not exempt from a canadian visa (especially for work), you should definitely get one. your AP does not entitle to enter any other country other than the U.S.

Hello Everyone,
My wife is trying to process visitor Visa for her parents and she has a problem with her mothers name in the Passport as it reads just the short name instead of her Full name.
I'm wondering if the Affidavit would be sufficient while going for Visa or would this still be a problem?
If affidavit is sufficient, can someone please kindly share the sample affidavit if you have one?

Scenario
L1 & I94 valid till late 2011 with comp A
new H1 with comp B approved effective November valid for another 2-3 years
Can some one still continue working on L1 or one must have to surrender L1 and need to switch over to H1.
What is the valid time period he can continue on L1 with comp A.

Hi,
My H1B was approved with a start date of 12th Dec 2010. However, the paperwork for the position has not been completed as yet by the HR of my employer and now they tell me that the start date of my position will be around the middle of Jan 2011.
This means that I will not get paid till the actual start of my position. So what is my legal status right now.
I have been told that on a H1B visa, If I am not working and getting paid for the position I was approved for, I am illegal.
Please advise me as I still have time to convey the issues to get the paperwork done right. What happens if my H1B start date is the 12th of Jan and my job paperwork shows position and pay from the 15th of Jan?

folks, with a lot of effort I got to know the case number of my AEC filed during mid 2001 ( P2002-XXXXX ) (EB3 RIR)
my company did not respond to the NOF due to lack of hiring and layoff's in the company... and then their policy is not to share the case number with the employee...
a standard answer that 'the application will be denied and has been denied' is being given by the HR.
what all can I try to get the status of this application... I have tried to email info@dallas BEC address and they wanted more info and currently awaiting their reply..
what would be the result of such an application? when NOF has not been responded to...
if a case has been denied..will there not be any paperwork from the SWA that it has been denied? or can this case get remanded and go as a TR case (non RIR)?
if anybody has faced something similar let me know... thanks!

Can anyone suggest if there is a way to check the priority date on a I-485 application after an interfile request has been made? I am not sure if a call to the Service Center is the only way, or if there is a form I can submit requesting this information.
The context of my question is this: My original I-485 application was filed based on a LC/I-140 approved by PERM with PD May 2005. But later, as part of backlog elimination, an older LC for me with PD Aug 2004 was cleared and my company's immigration law firm got another I-140 approved based on this earlier LC. They've told me that they contacted USCIS with a request to get my I-485 attached to the older PD. I would like to get this confirmed since a 9 month gap in PDs can easily translate to years more of waiting time.

I am completing 4 yrs of my H1 and currenty working with company. I already have my PERM & 140 cleared through this company (EB3).
Hence, if I continue with this company, I do not have to worry about 6yrs limit on my H1.
However, if I have to change my employer:
1. Now?
2. After completion of 6 yrs (i.e. H1 extensions) would I be able to do that?
Also, what will happen with my GC? Will that be fresh start from scratch?

Not surprising, but surprising that Luis would admit it. And if this is the case (and I think it is), then the question is whether we wait until 2011 or later to push again or finally decide it's time to look at other strategies like piecemeal reform (pass DREAM, AgJobs, legal immigration reform now and deal with legalization later) or look at administrative actions like TPS or parole and a moratorium on deportations for people who would otherwise meet the requirements of a proposed legalization program.
