The Boston Globe reports on another case of a potential DREAM Act recipient facing deportation. Alan, the individual who is the subject of the story, is the son of Mexican migrant laborers, came to the US as an infant and his academic success has been an inspiration to children in his neighborhood. Like many others, he did not learn he was illegally present in the US until he was much older - in this case, high school. The Globe notes that Alan is going to leave the US: Now Alan sees Mexico as his only option. His mother is against...

Hello!
I am pursuing part-time MBA while working for a company which has sponsored my GC. I am on EAD based on EB3 filing with PD of March 2005.
I plan to do a summer internship (10-12 weeks) at another company and need to understand the risks. This internship would be 40-hr/week so I will have to either
* quit my job and then search for another full-time job after internship is over, or
* take a Leave of Absence (LoA) for 3 months and come back to my current job
The first option is obviously very risky so I am inclined towards the second option though I don't know if my employer will grant me LoA. Could you please advice me whether doing an internship will be an issue later when my PD becomes current.
Thank you!!

This is what, I saw on Ron's forum. We would need to continue what IV has been suggesting since long .....
Can USCIS be sued for picking files in random ( the only time they budge is when a federal judge put an order ).
Ron Gotcher: Anyone can be sued for anything. In the absence of a large, well funded group of plaintiffs, however, I don't see this kind of suit going anywhere. For now, the remedy is Congress. Organize a group to initiate a letter writing campaign to Congress. Write to your own Congressman, your two Senators, and the chairs of the Senate (Kennedy) and House (Loftgren) immigration sub-committees. Get the facts straight and offer as much emprical evidence as possible. If Congress were to receive 100,000 such letters, they would definitely do something about this problem.

Very intriguing. Here's the lowdown from HuffPostHill: Luis Gutierrez, Nydia Velazquez and Bob Menendez will meet with the president tomorrow at 2:30 to talk immigration reform. Gutierrez says he'll push Obama to use his muscle to get the DREAM Act through Congress. If Rahm Emanuel shows up, two potential Chicago mayoral candidates will be in the room together. Gutierrez, who said today that a run is "tempting," said he'd have a hard time supporting Emanuel if he doesn't, given his history of slowing down immigration reform. He still remembers, Gutierrez said, when Emanuel, as head of the DCCC, was telling...

I guess you can, provided you gain the specialized knowledge during that duration (6 - 7 months) which you currently lack to get the approval.

Hey there
Can someone point me to a resource that will allow me to quickly colate info on positive and negative bills for us. Specifically (right now) ones in the Senate.
I posted about this yesterday, but my post vanished

The Arizona Republic reports that US bid to host the 2018 World Cup may be jeopardized by plans to include the University of Phoenix Stadium as one of the venues. This quote from the story caught my attention: 'We've got 18 cities that are part of the bid, and it's a long way between now and 2018 or 2022,' U.S. Soccer Federation president Sunil Gulati said last week when asked if Arizona wouldn't be included in the bid. 'At this point I think it'd be premature to make any decisions given the fact that the law is being challenged in...

Recently I filed a H1-B Part time Visa. I received the notice from the Lawyer that my application got a RFE on it.
Will they usually show the status online? When I check USCIS, it does not say my case had a RFE on it.
Please advice! Thanks!

My 485 application for EB2 was filed with USCIS on Sunday, July 1st 2007. My lawfirm is not sure if it will be accepted by USCIS since the filing was done in the weekend. Any comments? There could be lot of us in a similar situation. For those who are in the same boat, I would appreciate any updates you have received from your lawyer.
Thanks,

My employer is a single architect and owner of his sole proprietorship LLC firm and he filed an EB3 I-140 for me submitting the "Schedule-C" of his tax return, which shows a net profit of $57000 for the company. The prevailing wage for my architectural technician position is $35,100, and NSC is asking for my employer's personal financial documents, saying that they are not satisfied only with "Schedule-C" and Net Profit of his tax return and a sole-proprietor petitioner has to prove that he can sustain his household and the proffered wage. Can USCIS ask for personal finances when the net profit of the company is clearly greater than the prevailing wage? Has anyone been in the same situation? Any suggestions from the gurus?

Further to one of our more recent posts, it isnt just the economy driving the brain drain associated with the ever-increasing numbers of talented workers opting to leave the U.S. Rather, the unrealistic immigrant visa quotas for employment-based green cards are also to blame as a formidable obstacle contributing to this recent trend. The much-anticipated October visa bulletin issued by the Department of State did little to give new hope to the long line of skilled workers waiting for available immigrant visa numbers. Indeed, with quotas backlogged more than 7 years in the skilled worker category, countless thousands of talented...
