Since stay in India need to be very short and also my travel is very near, I need to know whether it is safe to travel on an approved I 797 from my current employer?
I already have a H1 B VISA stamped on my passport with previous employer's name that expires on 30 Nov 2009.
Also, I would like to know whether I should select yes/no to the following question?
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*
Is H1B Transfer = H1B Renewal?

Info I provided on G325 is correct. I have only worked for 'Employer #1' and 'Employer #2', which I entered in G325. I have never worked for 'Employer X' and I did not mention 'Employer X' in G325.

Well, It depends on whether you did a transfer from Employer #2 to Employer X OR Employer X filed a new H1B. If this is a transfer, you should not waste any more time on this forum, rather contact an attorney immediately and get help.

I dont think this bill has or will have any favorable provisions for us unless a miracle occurs.
I think the tech companies have cut a deal with the Senators through which they will have access to 115,000 H1Bs and more moving forward inlieu of no increase in EB green cards.

Check this thread which is dedicated to such questions. I think if you get married after your I-485 gets approved, it's a sign of trouble since your spouse will get into the family based category which is heavily backlogged for certain countries.

My pd is jan 2005 and i was waiting for the dates to become current.I am not married and will most probably get married by this year end[parents in the process of searching matches].my dilemma is whether to apply for 485 now or not.can i add my wife's name later on while the 485 is in the final stages of the process[say an year after the process began] or just before the green card is being dispatched etc so that both of us can get green cards.i dont want to miss this chance because i seriously feel that the dates might retrogress again.but if i apply and get a green card u all know how many years it will take to get wife to usa in family based immigration.somebody please clear my doubt.Thank you

Sorry for late jumping on this old topic. But, applied for SSN for my wife and got it in mail. Now what? My taxes for last year were applied in feb this year. How can I tell IRS that my wife got SSN now and she is eligible for Stimulus package?
Can I claim this amount next year when I file my taxes?

H1B transfer to another company does not automatically invalidate the existing H1B.
From his post it seems he was always in status and on H1B with some employer. He at some point thought of joining employer X, filed for transfer but then refused to join them.

OK we may be in slight uncertainty now but if this bill comes up most of us will be in deep shit:

change in h1b policy no new, no extensions, no transfers (crazy regulations thanks to Sanders and Durbin)
No H1b for medical residencies
No NIW for physicians
Nothing for nurses
US masters and other not H1b cap exempt
Worse retrogression (no relief)
Disaster for pending L certification and pending I 140s
No EB1 for outstanding aliens
New useless point based system (look at the point based system in Canada: PhD and masters are driving Taxis... ha!)
We must pray that this bill dies FOREVER.

I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.
I am not sure if another rally will help. I believe lobbing in DC, meetings with law makers will be more effective than rallying or trying to get public attention.
The rally that illegal immigrants made some time back had huge turnout and large media publicity - it was a success in that sense. But I think it was counter-productive for them. The fact that no pro-immigration bill had passed proves this.
I agree with the sense of urgency part. With the economy heading into recession and job market weakening, getting more skilled workers into the country will be the last thing congress will take up. So it is important to get something done sooner than later.

We do not have sufficient expertise to answer such specific queries .. Your company's immigration lawyer should be the best person to answer this. You could also try posing your query to an attorney during our conference calls.
In any case, a good employer would prepare for the worst case eventuality - that is assume that an audit notice is sent. If your company and its lawyer have been scrupulous about all the information they furnished during the PERM app there should be little trouble responding to it. In case they fail to satisfy USCIS, your company will get blacklisted and will be barred from filing PERM applications for some length of time (not sure what that is).I do not know of any direct consequences for the beneficiary himself.
My company went through a 10% workforce reduction company-wide just when my PERM application was ready to be filed. Although nobody from my group has been affected, 2 people with the same job title from a different group in the same office were affected. Their job descriptions are entirely different. I have about a year and a half before my H1B expires. I would appreciate anybody answering the following questions I have:
1. In Form 9089, should the answer to Item 26 be 'No' since nobody in my group or area of expertise was affected?
2. If the answer to Item 26 should be 'Yes', is it sufficient to notify and consider the people laid off? I am confident that they will not qualify for the position. How long should this 'notification and interview' period typically be?
3. I have heard that my company can be sent an audit notice. In such a case, is it sufficent to justify that the area of expertise is different. What is the success rate for this?
4. If the audit response is rejected, what happens then? I have been told that the employee will have to return to his home country immediately and cannot refile his PERM application.

I have had this query before. I had an H1B stamping on my passport for a company I never worked for. (Company A)
But, when I applied for a H1B for a different company (Company B). My lawyer asked me if I ever worked for them and received any salary from them ... this was a RFE on my H1B case.
All I did was replied to my lawyer with a negative answer to both questions (worked, salary for Company A).
I got my new H1B approval I guess within 30 days of that RFE reply.
You might want to contact a lawyer to draft a reply to USCIS though. I do not have a copy of the letter to provide to you ... Sorry!
