I may not need to tell you this but you are dealing with most greedy, money making machine in US govt. System. This organization churned out 200K EAD last year in 1 week, just so that they don't have to issue 2 years EADs. This org. is rejecting I-485 to get $1000 MTR fees, they will not spare any chance to take money from your pocket. I would say Instead of asking them for the fee waiver and wait 3 months for their 'NO', just give them the 5K and move on...
While it may seem that USCIS/DOS does what it does for increasing their cash-flow, real reasons are just those applicable to any government organization. Their demand for $5K was just a thoughtless response, which may always be their first response to all such public requests. The fact is that, what is sought should already be available for their decison making. Case should be raised with Ombudsman, for bringing out inefficiency such as this, in regard to crucial information needed for determining monthly cut-off dates, and forecastings. Ombudsman's office loves information on such systematic poor govt operations.

One thing I noticed in this thread is the lack of differentiation between attorney's who were hired directly by applicants as opposed to ones hired by the company one work's for.
I am sure there is wide gap in how law firms operate when interacting with either of the entities.
I would be interested in getting some references from people who have hired their own attorneys and their experience with that.
Even I am looking to hire an attorney to transfer my wife's case and then join the waiting game..

I am trying to donate $50 but every time I go through the "Donate" link it takes me to paypal site, where it says that the transaction could not be completed.
Did anybody else saw this problem?
Can I simply send the money to donations@immigrationvoice.org? The last time I contributed using paypal this was the email address that the money was sent to, the business member id was 878.

My case with PD of Aug 2002( EB3) was stuck at PBEC until May 23, 2007. PBEC had closed my case multiple times, and had to really fight to get it reopen and finally certified. I have sent emails to Sec. of Labor ( Elaine Chao) twice. Her office was helpful in opening my case. I got reply from her office within a month too. Also, I mailed senators too. Try to talk to senators from your states. I know and understand the pain of you guys, whose cases are stuck at BECs. Personally, I feel that you guys should mail Sec. of Labor, and let her have the attention of these cases. This is really injustice!

Please find out the visa numbers allotment for EB1, EB2 and EB3 till now. Till now there is about 100k visa numbers allotment for EB3 every year due to the vertical fallout. From now on there would be around 100K allotment in EB2 due to the change to Horizontal Fall out of visa numbers. Out of these 100k EB2 visa numbers, India will get greatest share of around 50k + visas. Please see the below.

I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.
If you have to get visa stamping outside US then you only need to show paystubs for current employer. The CO will check if you have been in status throughout your stay in US and might ask you why you change employers so many times.

There is no future for EB3. I have PD March 2005 but still have to wait PD to be current and then i have to apply for EAD. Where as my JOB requires EB2 but employer filed only in Eb3.
Dont worry.. More and More people are converting from Eb3 to Eb2 of late. Very soon, there will be a huge backlog for Eb2 and then Eb3 will move forward :)

The racism by AF might be true or might not be true as alleged. It may a transit visa issue alone or a purely a case of pathetic customer service. I would not jump the gun and side with the racist angle alone without more info.
As far as my experience with AF several years ago, the flight was not any more memorable than most European carriers I have flown. My baggage was delayed at Mumbai airport (baggage missed the connecting flight at Charles De Gaulle)...but they gave a me a free return ticket from my home town to Mumbai to identify and collect the bags. Further when I was back in the US they sent me an unsolicited check for $40 for the inconvenience caused!!

I really take exception to that comment. I have 2 Masters degrees (one from the US)...unfortunately they are not in Engineering/Science. What people don't seem to realize is that it is extemely difficult to get an H1-B if you are from a Humanities/Liberal Arts background. I'm a teacher and there are jobs in my field...the only problem is that school districts/community colleges/universities are unwilling to sponsor H1-Bs!

After reading Section 406 (immigrant visas for advanced degree holders of STEM) of senator Frist's proposal, I have come to the following conclusion. Please feel free to disagree with me.
Visas for Advanced Degree Holders:
(a) Aliens With Certain Advanced Degrees Not Subject to Numerical Limitations on Employment Based Immigrants-
Aliens who have earned an advanced degree in science, technology, engineering, or math and have been working in a related field in the United States under a nonimmigrant visa during the 3-year period preceding their application for an immigrant visa under section 203(b).
- MS and PhD holders in STEM can apply for I-140 & I-485 after three years of employment.
- They do not need to get labor certification and there is no country limit for this category.
- No need for employer sponsorship and no need to stick with the same employer after applying for I-140 & I-485.
- One can even apply for I-140 & I-485, get EAD and start working in a non-related field or open a non-tech related business.
This is my take on it. Opinions please!

Of course, much more work needs to be done here... hope folks in NORCAL are listening!
At my workplace, about 50% of them have have signed this letter now! This is including but not limited to employees with an immigrant background ( including but not limied to the Indians and the Chinese!)
My tally is now up to 253. Expecting another 2 this evening from a friend who got it from 2 of his own friends.
Recruit friends & strangers to help you, then follow up a little bit, it helps!

Are you people 'creating' new quota rules?? what is this 7% with regards to any category? 7% is the per country limit including all categories. EB1, EB2, and EB3 gets 28.6% each, out of the total available 140,000. This means each country will get 2802 visas for each of these three categories. However spillover can be redistributed to lower categories and to oversubscribed countries.
