Get copies of your 140 approval and labor filing papers. Look for a job and transfer h1b , you will get 3 years transfer/extension based on yiour approved 140.
Once you settle down in your new job, apply for new Labor in PERM (preferably EB2) , and you can port your earlier priority date.

I have never lived in Canda but married to a Candian citizen so I am writing this with her help and with my limited knowledge. I don't think 50K per year is enough, you may survive but living standard won't be as good, say, compared to Texas (if you are in CA then its different comparison). You pay more taxes, high insurance premiums, clothes are expensive etc. everything is higher. As per my bro-in-law, the sale price of houses in Houston is less that the cost of building house in Toronto (he is a financial consultant in Toronto). I heard socially Canada is better than US and have nicer people.
Heathcare is free (not dental, vision etc.) but you eventually pay more taxes for that so if you are planning to bring your parents this could be good but for healthy young family basically you pay more taxes for health of others. Healthcare can be compared to US but not as good because there is cap on doctor's income (300K??) and many good doctors move to US.
TN is defnitely good and hopefully it will remain for canadian citizens and can be renewed with no cap for maximum years but but your dependents can not work with your TN visa.

so the the US lists, the catagories as Mexico, India, china, and the philpines.
that is 4 counties..... with what ever percentage of the total visas..
But ROW the rest of the world.....how many countries is that???? i am guessing lots... i personally am only conserned with the UK as that is where i am at the moment. so how do i go about finding the number of visa's that the UK is aloted per year? in EB catagories.
because i dont see how if say Germay, or Italy used up all there visas for the year, but the rest of the world hadent, or even half and half....how can the entire of the rest of the world be retrogressed.??? is there not a list of how indervidual countries are retrogressed....? if this is stupid please say though, but i think it is quite a valid question.

What an absolutely useless discussion! EB2 and EB3 are based on each employer's attestation of job/work requirements.
Obviously, there is little correlation between book knowledge and real world results. Highly educated lawyers and Top B School MBA's can be found stuck in dead end jobs or suboptimal careers while barely educated street smart folks can be found enjoying productive careers.

The target is 1000. IV core group is not asking for funds now because we have done all we could to make our case and we have reached a ceiling. Now, it has to come from the heart of the members and if they feel we are doing the right thing they will contribute. Only few people put their phone numbers in their profiles. most register annonymously and a lot of nasty posts come from such members. Including the House session and Conference session, if somehow this is pushed beyond October 1st 2007, then the enactment will happen on October 1st 2008. We have to hope for that. That gives best possible window for all BEC, PERM-BEC candidates and people who have not filed their I-140s yet.
The impact is on H-1B renewals beyond six years, with the cut-off proposed at six years. The only exception for renewal beyond 6 years is given explicitly to people who applied for immigrant petition. So BEC/PERM-BEC people should apply for I-140 asap.

I know nothing about the law, but as far as I know today the democrats are trying to pass a bill in which the people living illegaly for over 2 years can apply for temporary working visa that will let their spouses work (nothing wrong with that, just the exclusion of the H-4s as spouses of temporary workers which are the only ones not allowed to work). If they do not get 60 votes today, it passes tomorrow to a compromised bill that it says that if you came to US before Jan 1, 2001 you can apply for the work permit, and the green card later and then the citizenship. If you came between 2001 and 2003 you have to go back and get a work permit and come back, and if you came after 2004 no special treatment. since nobody has included in the ammended bills the H-4s it cannot be discussed tomorrow, but I do not know what is the procedure to get a bill considered and debated, there is a bill that considers the H-4s right to work and it is called TALENT "Through the Advancement of Legal and Educated New Talent.” but who knows if it will get considered.

It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher
The more I read this form, the more I become disgruntled with this community! To say that someone from a lower class of visa and not from an "Oversubscribed country" (and I am assuming you mean India) is less skilled and less deserving than someone from a higher class and oversubscribed country is ludicrous to say the least. Each and everyone of us (and I mean "legal immigrants") have our own skill sets and contribute equally to the American society. As long as we are competent at what we do, then we are all SKILLED in our own way. The only real defining difference among the visa classes is the level of education not skill. To suggest one is better based on education alone is arrogance and nothing else!
The U.S. immigration system is not without its flaws and despite the delays and frustrations, it is FAIR! The per country limit is to ensure that citizens of ALL nations have an equal opportunity to immigrate to the U.S. and not just a select few. The only thing that I have found unfair as far as immigration in this country is concerned is the politicians' focused efforts to do something for the "illegal" immigrants at the expense of the "legal" immigrants.
We are all in this together and the insults and innuendos that dominate this forum divide us so let's stop them and focus on the real issues!

hello,
during the july 2007 fiasco i applied for i485 and i got my ead and ap, but i have not used the ead and still using and maintaining my h1.
Here is my dilemma, 2 years ago i went to india and used my ap when entering us though i had a valid h1 but i did not get the visa stamped and after entering us on ap i am still using and maintaining my h1 and not using ead. Recently i also got a 3 year extension on my h1.
Now i am applying for my new ap as the old one is expired. My question to you gurus is what should i put in the "class of admission" field? Shall i put the aos or h1?

The reason some of us long timers at IV are ired with the Ombudsman is because this drives us off message. We end up discussing non relevant topics.
We have one goal. Relief for thousands of us who are stuck in limbo because of antiquated immigration policies for skilled immigrants.
Today is a good day for us. Why? Because any change is better than the do nothing congress before this one. We need to be energized and reinvigorated to take this race to the finish line.
In times like this the Ombudsman is a distraction. His views are a distraction. When you start feeling helpless or get the age old feeling that nothing will happen, you have lost the battle.
We have one goal. Relief for thousands of us who are stuck in limbo because of antiquated immigration policies for skilled immigrants.

It happened because of relentless canvasing of the media until the story got out and embarrassed the government. "Supporting the troops" is a no-brainer for a politician wanting to score political points. Most Americans could care less about immigrants or other citizens who are married to them. So there is no political urgency to solve that "problem." Although the media has reported that the exclusion of legal immigrants was "unintended," my sources say that the exclusion was intentional.
I had hoped to embarrass the government further by exposing the connection to a known "hate group," but the media has refused to report that part of the story. If I could get the media to expose the racist origins of this law, we might have some hope, but don't count on it.
The next phase is to focus on legal options.
