I totally agree with you days_go_by. The US immigration law sucks. One the one hand they will keep on syaing that we have shortage of manpower and on the other hand they try to restrict. Every single head counts....even the persons on H4... H4's can also contribute to the economy...rather than a simple HEAD Count in this country.

You could have called the local finger print office, and asked to move to another day because of travel. They let me come in 2 weeks early because of a flight. I had tickets in hand but they didn't ask to see.

You definitely raise an interesting case. What I would say to that is that they just have to reevaluate the points allocation system. the details of the point allocation system may be bad but the overall intent still stands to benefit the highly educated while including the EB system as well will make sure less skilled but in demand people are also taken care off. handling family based GC is a whole diff ball game though.

I agree with most of your post, but to state that 5yrs of wait is not a catastrophic delay - you have to be really very patient, and frankly unimaginitive to know what you can do with your green card.
Going forward, only people hit with retrogression will wait for 5-7 years. And if you look at the percentage of people getting a green card, a large number of them will get it in a couple of years, while the rest of us will suffer the nonsensical country cap.
Companies hire individuals not only because they can get the job done, but also because they see that the individual will evolve in his/her role going forward. Which company will continue to keep you in the same position for 5 years, doing the same thing day after day? You have to be just dumb enough not to get promoted and with zero ambition to succeed.
Understand that we are stuck. This is not what we want.
There are companies that do not want you to evolve and despite your abilities keep you stuck in EB3: that way they get more out of you, unless you decide to quit and take further risks.

The basic idea behind this approach is to channel all the negative energy into something positive.
Here is what me and my wife are doing. When the retrogression first hit us in 2005 January we were both devastated even more so because one my friend and his wife, with same the same priority date as ours and similar EB3 RIR got the Green Card on 24 Dec 2004. We would not have been so frustrated if they had the priority date even a month or so before us. But some are just lucky I guess. Coming back to what we are doing. My wife started her masters and finished in May this year. She could have finished in December but we were really banking on the CIR in May so she took more courses and finished it faster. Well that did not happen so whats next. So now I will be starting school again for second Masters this time MBA from one of the top10 B schools in January 2007. Ideally I wanted to do Full Time because its shorter duration as compared to part time but GC God (I wish there was one like that so that I can do the "Nariyal Pooja" or "Mundan" or "Abhishek") had otherr wishes so I have now switched from full time to part time. Lets see if my part time MBA of 4 years wins the race or Green Card wins the racce against time.
Moral of the story. Channelize your energy into something positive and get masters or second for that matter, or learn a new language, enroll in classes to learn languages that run for 6 months at community classees by the time you get your GC you will know atleast a dozen languages.

too tired to celebrate...but hopeful that something might yet happen that will do something with the retrogression. hubby is already complaining that he reached the top in his senior position and there is no more professional growth for him, so the ability to file I-485 (if it happenes) would be a golden one for both of us... he would not feel so chained by his employer and I will finally say goodbuy to this wretched H4 status.
Will see where things move in the near future and hope for the best..

Hi Guys,
I was looking at the AP renewal instructions. It says:
1. If you are in the United States, you must attach:
a. A copy of any document issued to you by USCIS showing your present status in the United States; and
b. An explanation or other evidence showing the circumstances that warrant issuance of an advance parole document; or
c. If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application;
d. If you are traveling to Canada to apply for an immigrant visa, a copy of the U.S. consular appointment letter.
So what I gather from this is that they need:
a) Our H1B status papers and the previous copies of the advanced parole documents.
b) A letter stating why we need the advanced parole.
c) The I-485 receipt copies.
Now it DOES NOT say anything about the photographs if you are filing within the US.
Can someone who has applied for the Advanced Parole (NOT the EAD), please share their experience and what documents are needed. The EAD filing seems to be elaborately covered.

Plzz help me with this issue. I m currently in company A & got my visa transferred to company B but due to personal reasons i cannot join company B.
1) Can i stay with company A
2) Can company B take some legal action or force me to join them?
3) Now if i m with company A with my visa transferred to B can I go to india for a trip and come back for company A....I have to get my visa stamped also coz it was renewd here in america only?What can be the legal hassles in it?
4) Will company A come to know that my visa was tranferred to B when i go for stamping

Insulting TheOmbudsman it's just not acceptable, I though we were all H1B educated people who are open to discussion, not just a child crying and insulting as soon as someone contradicts you.
I know many people who stopped comming to this forum (contributing), they just get tired of those insults. If someone has a different opinion, is immediately insulted

Just reporting what I saw on CNN. During the Sen. McCain interview with Judy Judy Woodruff & Richard Stengel, Richard asked something like - what about the green cards for the highly skilled immigrants educated by American Universities. To this Sen. McCain replied implying - they should be given green cards sooner, I am not sure if they could be given automatic green cards but the process should be faster.....
He said it not exactly in these words but implying something to that effect. They were suppose to ask Sen. Obama the exact same questions. Did anyone see Sen. Obama's answer to the question about green card for high skilled immigrants from Richard Stengel? Just curious....
I found this on shusterman's regarding obama's views on immigration. Looks like he is all for family based immigration but no mention about employment based.

Here is my list. #1 is unprobable till 2009, so may be we can work on 2, 3, 4
1. Need a legislation change (to increase visa numbers).
2. If the above is not possible, recapture unused visa numbers.
3. If 1 & 2 not possible, exempt spouse and children from visa number counts.
4. If 1, 2 & 3 not possible, then atleast get them to disclose country wise backlog data, so that there is no "cheating" in visa bulletins
