Folks, don't make travel plans based on the approval e-mail that will be sent of automatically from USCIS. Mine & my wife's application's were approved and mailed nine days ago (6/18) and we made travel plans for yesterday (6/26) . Guess what. I got my approval notice in mail only yesterday and my wife's approval doc never came. We have to cancel the whole trip now.
Also, USCIS updated the status on our AP's four days later after the approval e-mail was sent saying the documents were mailed only on 6/22. Called the USCIS customer service three times and I got three different answers.
1. We sent approval notice on 6/18 and will be sending the AP document soon (In fact there is no such thing called approval notice and AP separately. This guy has no idea what he is talking about at the USCIS)
2. We sent the approval notice on 6/18 and confirmed that the document is out in the mail where in fact the document I received yesterday had a USPS stamping day of 6/22.
3. We sent the document on 6/22 and you should be gettting them in less than 30 days. If not please give us a call back.
Lesson learned. Don't trust USCIS and USPS delivery system and don't make travel plans unless you have all the doc's in hand.

The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.

i had sent an email to CISOmbudsman.. requesting allowing to file for AOS..as a mode of temporary relief...they replied..saying thanks for the input...
I think we must pursue this for now... since any meaning reforms are atleast couples of months away.. this relief can save lots of EB ppl during uncertain times.

What steps have been taken and what further steps are recommended to make sure that the full quota of permanent immigration spaces is used each fiscal year? What regulatory or legislative changes (including a possible pre-application filing procedure for adjustment cases) are recommended to facilitate caseload planning and make optimum use of U.S. Citizenship and Immigration Services adjudication capacity?
This is a great finding I've read that page, but never noticed the Secretary of DHS specifically mentioned Pre-Application of AOS. Now that they do have this in their mind, can we start working on that? I'd love to share a few thoughts I have on it:
From the lessons we learnt from the past, the most important thing for this admin fix to fly is compromise: there must be kind of restriction for the pre-application AOS. A few examples I could think of are:
- The person has been in the country LEGALLY for more than a number of years, OR
- The PD are more than a certain number years old, OR
- I-140 has been approved, OR
- Must have MS or higher for a US college (just for argument's sake, please don't flame me).
The key is to not allow everyone to file pre-application or it'll be drown in a media storm and draw backfires. Yet it gives you a certain promise that you'll be able to file pre-application once you are here for a certain period of time, so everyone has hope and those who has suffered more would have an almost certain chance to do so.
IV core, should we work on this? This is the first time we see pre-application of AOS appears in official file and I believe it's a great opportunity.

I have never lived in Canda but married to a Candian citizen so I am writing this with her help and with my limited knowledge. I don't think 50K per year is enough, you may survive but living standard won't be as good, say, compared to Texas (if you are in CA then its different comparison). You pay more taxes, high insurance premiums, clothes are expensive etc. everything is higher. As per my bro-in-law, the sale price of houses in Houston is less that the cost of building house in Toronto (he is a financial consultant in Toronto). I heard socially Canada is better than US and have nicer people.
Heathcare is free (not dental, vision etc.) but you eventually pay more taxes for that so if you are planning to bring your parents this could be good but for healthy young family basically you pay more taxes for health of others. Healthcare can be compared to US but not as good because there is cap on doctor's income (300K??) and many good doctors move to US.
TN is defnitely good and hopefully it will remain for canadian citizens and can be renewed with no cap for maximum years but but your dependents can not work with your TN visa.
I, myself, have applied for Canadian PR and should get it soon but that's just as stand by and won't move there unless I have to.

Based on your comments I could see that you are a regular visitor (FREE RIDER ATTITUDE) to IV site for more than a year. We had several threads crying out for funds in very critical time senstive times. At those times you are a mere spectator and now just for posting this bashing post you reluctantly became a anonymous member. All these shows your LEADERSHIP skills and quality of leading the battle from FRONT. If I were in USCIS I would do a background check on these high qualities and ground breaking positive attitudes even before giving H1.
