People just don't want to soil their hands in cleaning their house but want others to do it for them.

There is a reason why Indians are required to take a transit visa. Coz, in the past there have been Indians (at EU airports) who have claimed that they have lost their memory, do not remember who they are, don't have any ID and hence qualify for asylum on medical grounds. Now these gov'ts are requiring ALL Indians to have a transit visa so that if anyone pulls such antics, they have all the information that they need to identify the individual and deport. Some bad apples have f&^%ed it up for all of us.

Any updates ?
I contacted the lawyers a few times to see what they were doing and they said they were working on it. But to be honest, I got tired of doing this on my own, and the lack of updates from the lawyers makes me doubt that anything will be done.
In fact, the current economic situation casts doubt on my employment, so I am not sure how long I will be in the US. Hopefully I can ride this out, but obviously I have other things on my mind. I need at least one more year working in the US to be eligible for social security. So I am keeping my fingers crossed.

I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?
No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.
India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

Subject: Injustice :mad: for people with priority dates in '02, '03, '04 etc. who are still waiting for their labor certs to be processed using the traditional process - we want to file a case against DOL's lethargy - Let us join together and file a case against DOL and bring justice to this unjustified system.
The manner in which the backlog reduction center have been processing the
labor certs seems to be very unfair for people like me and others who have been affected. I know of cases with priority dates as late as 2005 that have gone through the traditional process and have been approved already. And there are cases like mine and others with much earlier priority dates that haven't been done. This is very unfair and unjustified. It is like we have been standing in the queue for several hours and a person who came much later than me just sneaked into the queue and got his service done while I am still waiting for my turn. Also the fact that now the UCIS has made the filing of I-485 current adds more insult to the injury that I and others in my position have endured.
The fact that the I-485 was made current and then withdrawn was made a big deal and people wanted to file cases, whereas the plight of people like me who are still waiting for the labor cert to be cleared has been totally
ignored, inspite of the fact that people who applied for labor much later
have been approved through the traditional process.
We want to file a case ASAP with the DOL or other relevant
authority regarding this issue and the unfair way of the process that we
have been subjected to. So can all those folks who have been affected by this join and voice your support? We shoud put up this fight because this is in no way justified. Why would it be?
The next steps should be:
- Get all of the support we need from all affected folks ASAP
- Get in touch with a lawyer who can help us to prepare the case
- File the case in a court against DOL
- Make sure we get justice

We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter and deliberate disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on the DOL web site that they have tried to maintain FIFO, it makes me feel like puking.

This law suit will bring public scrutiny to the misdeeds of the DOL.

You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.
i think by the time i finish my Ph. D. or part time MBA,i would have got my canadian PR....so i'll just apply for canada and wait instead of slogging it out with phd or mba

I don't think i should necessarily agree with this statement. The shortage of manpower is w.r.t US Citizens with specialized skills...hence they recruit specilized people on H1/L1 categories which are known as specialized skilled employees. They won't bother about others unless they hold H/L.
Moreover, they have to think about unemployment issue caused by foreigners. Hence, I think they can't allow anyone work just like that...
I can see the most wierd issue with immigration law is that GC Holders can't bring their spouses on any dependent visa just like H4. In that sense, H4 is a bit better than 'foreign spouse of a GC holder'.

I unfortunately sat through most of it, and the vitriol that people like Bernie Sanders and Dick Durbin have spewed on H1Bs has left me a bit shaken and a bit bitter. Forget about taxes, we are paying into medicare and social security (which we wont get to use) all these years and yet we were treated like trash. At the same time the red carpet was laid out for illegals who have not even paid taxes, have broken multiple laws...
I dont know if there was even a 5 minute period in the senate where someone said something positive about the contributions that H1Bs have made here. I doubt if we have any chance of getting any favorable amendment in this atmosphere.
It felt as if we went into a massive swordfight (Kill Bill style) armed with toothpicks. The fact that we got away with just scrapes and bruises is victory in itself.

There are a few things missing in SKIL bill that we would like to get introduced. Mainly its the 3-year extensions of EAD and AP and 3- year ext of H1 for labor applicants that is missing.

I am not on AF payroll, so please don't use your choicest abuse on me if it seems like I may be defending their actions a bit here. What I really want to do is give my experience with AI and the facts that comes sout of it and see if you would agree something similar could have happend with our fellow citizens on AF.
I was travelling on AI ORD-MUM via FKFT. Similar to what happend at CDG airport, just minutes before my plane was about to land at FKFT, the right engine shut off and at FKFT airport, it was reported that a mechanic from London etc will have to fix it. After 3 hrs it was reported that it cannot be fixed and a new plane from somewhere in Europe will have to come and carry us to Mumbai. In the meantime they gave us coffee and fruits. Old and people who were less able got some blankets etc to lay down, but in general, mist of them were just loitering inthe airport. AFter 5 hrs or so, all US passport holders (and of course EU) were told, they could go out and stay at a hotel and come back next morning, which would be the earliest the plane would take off. All the Indian passport holders were told,we could not go out due to visa restrictions. But AI started negotioations with the Polecie of Germany to see if we could get some type of temp visa. 12 hours after the start of the ordeal AI was able to obtain a group visa for us at midnight from the German Policei. Note that most of the admisnistartive work to get the visa was really managed by the Indian passengers themselves. Ther was probably 1 AI personnel to do/direct some of the things, but after a while the polecie started talking surectly to us on next steps.. All through this we went to have 3 scerurity checks at different points in the airport. We were put in the same hotel ( as swanky Marriott in heart of FKFT) as the US/WU citizens. We spend the next 36 hrs(yea, there was no plane from Europe to carry us) in the hotel before we got a plane from Mumbai to take us back.
So putting all this in context, I was happy that AI did help us when the situation was dire.with hotels and food etc. But they cannot help you with the Visa situation. I am assuming that it was the same predicament for AF. I agree not treating the pasengers well in terms of politeness, food , temporary lounge etc is not an excuse, esp at CDG which is AF's home.

We are very interested in this provision. Immigration Voice has heavily invested in this measure, both, legislatively and administrative. We have consistenly advocated for this provision which we believe will curb arm twisting by bad employers, that are like few bad apples in the big basket. Such a provision will help everyone including USCIS, lawyers, genuine companies, and direct+indirect beneficiary. Its a win-win for all.

I guess, in the vast scheme of things, getting biometrics (even with past appointment date) is much better than having to battle the .."GC approved when PD is not current"..situation. :mad:
at least, company's att sent h1B under premium processing. If all goes well I plan to come back before they re-schedule biometrics...
