I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.
Now my problem is I not sure whether my transfer from A to C would be successfull or not?
Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

Can't they reuse the same "program", as they call it, to provide us the info that we requested for? I would suggest to atleast include a reference to this Ombudsman's request in our reply letter.

Are you not happy, you are not alone. Do not worry at all just file your H1 in time & you will get extension for 3 more years.

I got hired by a consulting company A. I had to pay my H1B Fees (at that time i didn't know it was illegal for a company to do that)they were delaying my joining as they were indefinite for finding a job for me. I came to charolette in november start and was asked by the employer not to join them as they didnt have any projects for me. It has been 3 months and iam sitting idle and running out of resources to sustain myself. No paystubs are generated and i might be given an offer by a regular company B for permanent here . H1B txfr requires last paystubs
which i donot have, but when company B want to hire me what can i do. Talking about my employment to employer A he threatens to revoke my H1B, is there a way out.
Also in case he wants to revoke my status on H1B could i also complaing to DOL for non payment of pays and that he made me pay H1B fees.
Please Advice.

I filed I-140 on July 5, and was hoping to get the receipt by this week because as per the press release ( dated 7/13), NSC was supposed to be time complaint with regards to I-140 receipt date by 7/18/2007. But they again changed to 8/1/2007. You never know they will NOT change it again!

IV shouldn’t deviate from it’s agenda and leave the lawsuit to AILA attorneys who where dreaming about windfall with the announcement of EB visa number availability. Why would IV collect money from members for somebody else’ cause?

My company started the PERM process for me about 2.5 months ago. I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). After which they are going to start the recruitment process. So I'm not sure if the time line is okay or should I be chasing them more frequently? Please advise.

Also most Law firms prefer to repond to HR and Leagl since this will keep the number questions to min. You should keep the communication going and keep checking on every step. You have the benefit of so many IV memebrs who can help. Join the local State Chapter and there you will meet people who can provide sound advice.

Its personal choice if and when they want to start the GC process if there is an opporunity. I also didnt start my GC even though my first employer wanted to start the GC for me in 2005 and I refused for whatever stupid reasons...which I am regreting now
Yeah me too, in 2005 a company wanted to apply for me in EB3, though I was qualified for EB2. I didn't feel it was right to apply in EB3, unless you were a fresher.

its probably a better investment to get a Masters degree in your specific area than an MBA. Of course then you get pigeon holed in your specific area
I agree: the MBA gives you perspective on strategic management and is useful in every field. But if it is not from the very very best schools, I would go for an MS in your own field. An MS from Univ of Arizona is almost as good as an MS from Berkeley when it comes to propelling your career. But an MBA from Berkekely is a different story. Of course, it is very hard to get into those top schools.

Come on man....there is nothing called transfer. Every H1B is new. Only thing is its not counted against the cap when you change the employer.

Anyone falling into his trap and fighting on the thread ?
Martiansoldier really belongs not on Mars but in a mental asylum. Please don't post on this thread unless it has really got something to do with PIO card or the Indian consulate.

When I mean attitude of the people that speak it, I mean the attitude of those that speak it to me after I have politely mentioned in English that I do not know the language and yet those morons begin a lecture that I have to know the language because I am a citizen of the nation and it doesn't matter where I live. The constitution of India does not state that every citizen of India must know Hindi nor does it state that no matter where in the world an Indian lives, he must know Hindi to be an Indian citizen.
At the end of the day, no matter what anyone says or thinks of me, I still don't have one good reason to learn Hindi! Yet, I am a Proud Citizen of Indian and there is nothing that people like hpandey or ameryki can do about it! This is the truth and so will it remain!
